These Terms and Conditions govern the agreement between you and The Soulfluence (WA) Pty Ltd (ABN 17 684 015 272 ) (“The Soulfluence”, “we”, “us”,“our”).

This agreement consists of:

  • These Terms and Conditions
  • The completed Application Form, including the Application Questionnaire (online or offline)
  • The Enrolment Package Outline
  • Our Privacy Policy

The Agreement

By signing the Application Form, making a payment, or enrolling online in a The Soulfluence Coaching, Speaking, or Retreat Program,
you agree to these Terms and Conditions (“Terms”) and our Privacy Policy.

Please review these Terms carefully before signing up for our services. If you have any questions, please contact us before proceeding.
We recommend that you keep a copy of these Terms for your records.

Definitions

  • Application Form – The document containing your personal details, selected The Soulfluence Program, and agreed payment method.
  • Application Questionnaire – A questionnaire about your goals and business, completed after enrolling in a The Soulfluence program.
  • Enrolment Package Outline – A document detailing your chosen The Soulfluence program and the included services.
  • Event – Any retreat, seminar, coaching session, networking event, or online/live session organized by The Soulfluence Coaching.
  • Intellectual Property – Any copyright, trademarks, or proprietary materials provided during the program.
  • Losses – Financial losses, damages, legal fees, or other costs incurred.
  • Minimum Deposit – The required deposit for enrolling in a The Soulfluence program.
  • Online Content – Any digital material provided by The Soulfluence, such as ebooks, videos, webinars, and courses.
  • Paid in Full Payment – Payment of the full program fee upfront.
  • Participant – Any individual enrolled in a The Soulfluence program.
  • Payment Plan – An installment-based payment arrangement for The Soulfluence programs.
  • Grace Period – The period after program completion in which you can still access certain events.
  • Selected The Soulfluence Program – The level of services selected at the time of enrollment.
  • The Soulfluence Client / You – The individual named in the Application Form.
  • The Soulfluence Website – www.gracenajean.com and any related subdomains or online platforms.
  • The Soulfluence Coaching Packages – All coaching, speaking, and retreat services offered by The Soulfluence Coaching

Enrolment & Payment

1. Enrolment in a The Soulfluence program is subject to approval. The application process includes:

  • Completing the Application Form and Application Questionnaire.
  • Making a Minimum Deposit or Paid in Full Payment.

2. The Application Questionnaire helps us:

  • Assess your suitability for the program.
  • Confirm your commitment to the full program duration.
  • Personalize the program to your needs (if applicable).

3. Payment can be made in full or through a Payment Plan.

4. Prices for all programs are listed in the Enrolment Package Outline and may change at any time.

5. The cost of the program does not include travel or accommodation for in person events.

6. Paid in Full Payment offers a discounted rate compared to the Payment Plan.

7. If you do not complete a Paid in Full Payment before the final due date, you will be charged the Payment Plan rate.

8. Once accepted into a The Soulfluence program, you are responsible for full payment, regardless of whether you complete the program.
     No refunds will be issued, and all payments must be made.

9. Payment Plans require valid credit/debit card details. Payments must be made according to the agreed schedule.

10. If a payment remains unpaid for 30 days, the full balance becomes due immediately.

11. Your program cannot be resold, transferred, or shared without written approval from The Soulfluence.

12. If you register for an event or retreat and do not attend without prior notice, a rescheduling fee may apply.

Cooling-off Period

13. You may cancel your enrolment within 7 days of signing up (the “cooling off period”). A refund will be issued, minus the non-refundable Minimum Deposit.

14. The Minimum Deposit covers any intellectual property bonuses provided at registration.

15. To cancel during the cooling-off period, send an email to hello@gracenajean.com with “Cooling Off Cancellation” in the subject.

16. Refunds will be processed within 10 days after approval.

17. After the cooling-off period, no cancellations or refunds will be granted

Payment Plan Terms

18. Payment Plans require equal installment payments.

19. Any changes to a Payment Plan must be requested in writing.

20. If your payment details change, notify us 10 days before the next payment.

21. If a payment is declined, additional fees may apply.

22. If payments remain outstanding, the full program cost will become immediately due.

Refunds & Termination

25. If we cancel a program, we will reschedule it. If rescheduling is not possible, a full refund will be issued.

26. After the cooling-off period, no refunds will be granted, regardless of participation level.

27. If you experience personal hardships (e.g., terminal illness, extreme financial difficulty), you may request termination of your Payment Plan.
     Supporting documentation is required, and approval is at The Soulfluence coaching’s discretion.

28. If approved for termination, no future payments will be required, but no past payments will be refunded.

Your Commitment

30. By enrolling, you agree to:

  • Fully participate in your selected The Soulfluence program.
  • Commit to completing all coaching sessions, events, and coursework.
  • Follow program guidelines and respect the community

31. We reserve the right to terminate your participation without refund if you:

  • Violate these Terms.
  • Disrupt the program.
  • Fail to adhere to program expectations.

Intellectual Property

39. All The Soulfluence materials (workbooks, videos, courses) are protected by copyright and cannot be shared or reproduced without permission.

40. Unauthorized use of our intellectual property may result in legal action.

Liability & Disclaimer

41. We do not guarantee specific results from any program. Success depends on your dedication, effort, and external factors.

42. Any information provided during the program is general advice and does not replace professional legal, financial, or medical advice.

43. You agree that The Soulfluence (WA) Pty Ltd trading as Grace Najean and The Soulfluence Coaching is not liable for any losses or damages resulting from your participation.

44. In the event of force majeure (natural disasters, strikes, etc.), we may reschedule programs

General Terms

45. This agreement is governed by the laws of laws of the state of California, United States.

46. If any part of this agreement is found invalid, the rest remains in effect. 

47. These Terms may be updated at any time. Changes will be communicated via email or website updates
